Key takeaways
- The EC Sales List reports your sales of goods and services to VAT-registered customers in other EU member states.
- It distinguishes three kinds of transaction: supplies of goods (L), triangular transactions (T) and services (S).
- Its frequency follows the VAT return; a quarterly filer switches to monthly above EUR 50,000 of goods supplies in a quarter.
- Filing is on Intervat, on the VAT return's deadline: the 20th of the month for a monthly filer, the 25th for a quarterly filer.
As soon as a Belgian business sells goods or supplies services to a VAT-registered customer established elsewhere in the European Union, an obligation is added to the VAT return: the EC Sales List, known in Belgium as the relevé intracommunautaire. This statement lists, customer by customer, the transactions carried out without Belgian VAT because the tax is due in the customer's country. The authority uses it to cross-check these flows between countries and to spot anomalies. The obligation comes from Articles 262 to 264 of Directive 2006/112/EC and, in Belgian law, from Article 53sexies of the VAT Code.
The stake is not theoretical. A forgotten, late or inconsistent statement draws scrutiny and exposes the business to penalties. This article explains who is concerned, what is reported, and how to file without errors.
Who must file an EC Sales List
The obligation applies to any person registered for VAT in Belgium who, over a period, carries out at least one reportable intra-community transaction. Size is irrelevant: an SME, a self-employed person or a large company are treated the same the moment they invoice a business customer in another member state without charging Belgian VAT.
Three families of transaction trigger the filing: exempt intra-community supplies of goods, triangular transactions, and supplies of services taxable in the customer's hands. Conversely, sales to private individuals (covered by the One-Stop Shop, see the One-Stop Shop OSS), purely domestic transactions and exports outside the EU do not appear on the statement.
One key point: if no intra-community transaction took place during the period, no statement is to be submitted for that period. There is no "nil" statement to file as a precaution.
The transactions to report: codes L, T and S
Each line of the statement carries the customer's VAT number in their country, the total amount of transactions for that customer in the period, and a code specifying the nature of the transaction. Three codes structure the document.
The three codes of the EC Sales List
Code L: supplies of goods
Exempt intra-community supplies of goods (Article 39bis of the VAT Code), dispatched to a taxable person in another member state.
Code T: triangular transactions
The supply made by the intermediary in a three-party sale (ABC triangular transaction), where the simplification applies.
Code S: services
Supplies of services on which VAT is due by the taxable customer established in another member state (reverse charge on the customer's side).
The customer's VAT number is the keystone of the statement: it is what the authority cross-checks against the customer's own return in their country. A wrong or inactive number breaks the cross-check. Verify it systematically in the European VIES database before invoicing without VAT, because an invalid number calls into question the exemption itself. For the framework of B2B sales between EU countries, see intra-community VAT.
EC Sales List, VAT return and Intrastat: do not confuse them
Three obligations look alike and all concern intra-EU trade, but they do not serve the same purpose. Confusing them leads to neglecting one of them.
| EC Sales List | VAT return | Intrastat | |
|---|---|---|---|
| Purpose | Cross-check intra-EU sales by customer | Compute VAT due or the credit | Statistics on trade in goods |

| Triggered by a threshold | Monthly above EUR 50,000 (goods) | No | Yes, assimilation thresholds |
The EC Sales List and the VAT return are both filed on Intervat and share the same deadline, but the statement details each customer, which the return does not. Intrastat, in turn, falls under the National Bank of Belgium, covers only movements of goods, and is triggered by separate thresholds.

Filing frequency and submission via Intervat
The frequency of the statement follows that of your VAT return. A monthly filer submits a statement each month; a quarterly filer, each quarter. A switch rule applies, however, for goods: a quarterly filer who crosses EUR 50,000 of intra-community supplies of goods in a quarter must move to monthly filing. This threshold is the one set by Article 263 of Directive 2006/112/EC to frame the quarterly option.

The deadline follows that of the corresponding VAT return: the 20th of the month following the period for a monthly filer. Since the VAT-chain reform that took effect on 1 January 2025, quarterly filers have until the 25th of the month following the quarter. Filing is exclusively electronic, through Intervat. For the overall VAT deadline calendar, see the periodic VAT return.

Avoiding the costly mistakes
Most penalties come not from fraud but from an oversight: a statement left unfiled while the VAT return reports intra-EU sales, an invalid customer number, or an amount that does not match box 46 of the return. The authority cross-checks these amounts precisely, and a single discrepancy is enough to open a request for explanation.
The best prevention is upstream of the invoice: reserve the exemption for customers whose VAT number is verified, code each transaction correctly from the invoicing stage, and file the statement in the same pass as the VAT return. A tool that keeps this information up to date throughout the year avoids the last-minute reconstruction that breeds errors.

What is the EC Sales List?
The EC Sales List, known in Belgium as the relevé intracommunautaire, is a recapitulative statement that a Belgian taxable person files to report sales of goods and supplies of services to VAT-registered customers established in another EU member state. For each customer it shows the buyer's VAT number, the amount and the nature of the transaction. It complements the VAT return and lets the tax authority cross-check intra-community flows.
Who must file an EC Sales List in Belgium?
Any person registered for VAT in Belgium who makes exempt intra-community supplies of goods, triangular transactions, or supplies of services on which VAT is due by the customer in another member state. If no intra-community transaction took place during the period, no statement is due for that period.
What do the L, T and S codes on the EC Sales List mean?
Code L covers exempt intra-community supplies of goods, code T covers triangular transactions (the intermediate supplier in a three-party sale), and code S covers supplies of services on which VAT is due by the customer established in another member state.
How often is the EC Sales List filed?
The frequency follows that of your VAT return, monthly or quarterly. A quarterly filer must switch to monthly filing once intra-community supplies of goods exceed EUR 50,000 in a quarter, a threshold set by Directive 2006/112/EC.
How and when is the EC Sales List filed?
Filing is electronic, through Intervat, the FPS Finance portal. The statement shares the deadline of the corresponding VAT return: the 20th of the month following the period for a monthly filer, and the 25th of the month following the quarter for a quarterly filer since the VAT-chain reform that took effect on 1 January 2025.
